Low level cases such as marijuana possession cases have flooded the Cook County court system for years. This new policy is intended to handle drug abuse as a public health issue instead of a crime. Prosecutors believe that criminalizing nonviolent, repeat drug offenders is not helping, and it is also too costly. The best way to help these repeat offenders is to direct them to treatment versus placing them in jail. The new policy will refrain from proceeding with misdemeanor charges for marijuana possession of 30 grams or less, against offenders who have less than three related arrests. Individuals with three or more arrests will be enrolled in drug rehab and charges will be dropped upon successful completion of the program. Individuals with a significantly violent criminal background will be receive alternative prosecution that will still allow them to receive treatment and social services.
