(IT-NEWSWIRE.COM, July 16, 2015 ) Melbourne, Victoria -- With the growing interest in hidden cameras Panther - who sell Spy Pens via Amazon - shared some insights around the legalities and privacy laws in the USA.
Jim Seymour - Founder and Director of Bluecostore who sell the PC-02 Spy Pen via their brand Panther said, "There is quite some confusion around what is legal and what is not legal in the arena of privacy, intrusion and gathering of information, and how that relates to the recording visually or audibly of groups or individuals". Jim also stressed that , "Customers should of course always be familiar with local laws and regulations before using hidden camera devices".
Specifically Panther understands that in the USA at the time of going to press;
Individuals would typically not be liable for intrusion photographing or capturing video of people in public places, even if consent to being recorded had not been sought. This comes back to the premise that individuals should not have a reasonable expectation of privacy when in public. In addition, intrusion can not be alleged if private information is gathered from documents that are available to the general public. The definitions of what constitutes a public or a private location should always be clearly understood in the local jurisdiction.
Further, If the intention is to take photographs, video, or audio of people engaging in private activities in places where they would reasonably expect privacy, privacy and intrusion laws will most likely result in liability. Panther does not advocate activities such as this.
Using a recording device, such as a microphone, video recorder, or camera, is often a helpful way to capture and preserve information about conversations, meetings, and phone calls. Before concluding that these activities are liability free, Panther suggest that local laws and by-laws, most specifically regarding the gathering of private Information, is clearly understood. That is being clear on whether the environment in which the information (Images, Audio, Video) is gathered is legally considered private or public.
